Revolution in the legal processes with e-Trial
The test of the e-Trail system, which enables lawyers to attend the s in different cities through the ‘UYAP Lawyer Portal’, was carried out successfully on June 15 at the Sincan West Courthouse with the participation of Minister of Justice Abdulhamit Gül.
Minister of Justice Abdulhamit Gül, who made a statement after the test, emphasized that e- has become a part of the legal proceedings. Our lawyer friends and colleagues will be able to present at the trial from wherever they are. The test was successful. There will be no longer a need for commuting 500-600 kilometers for a trial that takes a few minutes.” Gül said: “Today, we are here with an important development within the framework of the will of reform. With the e-Trial, we connected to our Afyon, Edirne and Çorum Bar Associations. We heard the very nice voices of our bar associates as if they were here. They attend the trial and voice their statements, and within this framework, an important revolution and reform will be realized in terms of procedural economy. The test’s success is exciting for us.”
e-Trial will be integrated with CELSE(trial) program
Noting that the e-Trial application is an alternative, Minister Gül stated that lawyers can benefit from the application if they request it. Gül stated that: “In our law, this is possible with the agreement of the parties, however there was no technical infrastructure. There is today. Thus, it will be ensured that our lawyer friends attend the trial in this sense. When the lawyer enters the UYAP portal and lists all of his trials, he will make a request to any court trial he wants to attend by e-trial and forward that request to the court. When the court approves the request by accepting the request, the lawyer colleague will have the opportunity to attend the trial wherever he is. It will be a very important revolution in order to speed up the trials and to result in a fairer and reasonable time. We will be able to monitor the trial and integrate it with the CELSE program. They will be able to enter the system by verifying their identity with their mobile phones and continue their services for our citizens by working from their location. We started an application where our judges, prosecutors and lawyers as well as our citizens will be satisfied and trust in the judiciary system will increase. With integration into CELSE program; we will expand the practice in criminal cases. We will implement this pilot practice in certain courthouses and by expanding its scope. At the same time, our lawyers will be able to look at the file on the screen, make a statement in this sense, make a petition and see the written statement of the judge.”
In the test session of the e-Trial system; Afyonkarahisar, Çorum and Edirne Bar Association Presidents were included in the system visually through UYAP.
What is included in the e-Trial?
With the new system, lawyers will be able to submit their request by looking up their trials from the UYAP Lawyer Portal, by writing their reason up to 24 hours before the relevant trial. If the judge accepts the request through the system, the lawyer will be able to connect to the Trial via video conference. The e-Trial will begin when the court activates the system. In the system whose software is made by the engineers of the Ministry of Justice, lawyers will be able to participate in the e-Trial after authenticating with the electronic signature method. The trial will start after the information and photo of the lawyers are confirmed by the court over the UYAP system. Security measures such as face scanning and fingerprints are planned to be added to the system in the future stages. Studies on the participation of experts are continuing. In addition, the e-Trial system will work in full compliance with the CELSE application.
